Petition Campaign on the Case of Temizöz and Others



At last, the final hearing of the “Temizöz and The Others” case have cleared all the suspects - including the leading suspect, Cizre Town Commander of Gendarmarie retired colonel Cemal Temizöz, along with former Mayor of Cizre Municipality Kamil Atağ, Kukel Atağ, Temer Atağ, Adem Yakin, Fırat Altın (Abdülhakim Güven), Hıdır Altuğ and, Burhanettin Kıyak - of the crimes that brought them to the court. The court case was considered to be a test for reforms and Turkey's will to come to terms with the atrocities of ethnic conflict during 1990's. 
 
Cemal Temizöz and the other 7 defendants were being tried for the crime of enforcibly disappearing and extrajudicial killing of 21 individuals, formally indicted for “forming an organization with the aim of committing crimes, and to join this organization by becoming its member to incite to murder and to murder.” On April 18, 2015, at the hearing before the final, Eskişehir Second High Criminal Court decided that the opinion of the investigating (prosecutor’s) authority with regard to the accusations, the statements of the witnesses and there being no certain, probable, credible evidence in harmony with conscientious convictions, and hence that the eight defendants be acquitted individually and separately. In the final hearing on November 5, 2015 the court confirmed the prosecutor's view, and hence, the well known commander Cemal Temizöz and 7 members of its counter insurgency team were acquitted.
